DMCA Policy

Overview

Pirobeta Labs LLC ("Pirobeta Labs") respects intellectual property rights and complies with the Digital Millennium Copyright Act (17 U.S.C. § 512) ("DMCA"). This policy describes how to submit a copyright infringement notice, how to submit a counter-notice if you believe content was removed in error, and our policy on repeat infringers.

Pirobeta Labs has designated a DMCA agent with the United States Copyright Office as required by 17 U.S.C. § 512(c)(2). Contact information for our designated agent is provided below.

Designated DMCA Agent

We strongly recommend sending notices by email for the fastest response. Physical mail is also accepted at our registered address on file with the Florida Division of Corporations.

How to Submit a Takedown Notice

If you believe that content available on or through Chuapi infringes your copyright, you may submit a takedown notice to our designated agent. To be valid under the DMCA, your notice must include all of the following:

• A physical or electronic signature of the copyright owner or a person authorized to act on the owner's behalf
• Identification of the copyrighted work claimed to have been infringed, or a representative list if multiple works at a single site are covered by a single notification
• Identification of the material that is claimed to be infringing and that is to be removed, with information reasonably sufficient to permit us to locate the material (e.g., the URL)
• Your contact information, including your name, mailing address, telephone number, and email address
• A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law
• A statement that the information in the notification is accurate, and, under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed

After We Receive a Valid Notice

Upon receipt of a valid DMCA takedown notice, Pirobeta Labs will:

• Remove or disable access to the allegedly infringing material promptly
• Notify the user who posted the content that it has been removed (where we have contact information)
• Provide the user with a copy of the takedown notice (with your personal contact information redacted if you request it)
• Inform the user of their right to submit a counter-notice

How to Submit a Counter-Notice

If you believe that material was removed or disabled as a result of a mistake or misidentification, you may submit a counter-notice to our designated agent. Your counter-notice must include:

• Your physical or electronic signature
• Identification of the material that has been removed or disabled and the location at which the material appeared before it was removed or disabled
• A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification
• Your name, address, and telephone number
• A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or Miami-Dade County, Florida, if your address is outside of the United States), and that you will accept service of process from the person who provided the original takedown notice

After We Receive a Valid Counter-Notice

Upon receipt of a valid counter-notice, Pirobeta Labs will forward it to the party who submitted the original takedown notice. If the original complainant does not notify us within 10 to 14 business days that they have filed a court action against you, we may, at our discretion, restore the removed material.

Repeat Infringer Policy

Pirobeta Labs will terminate the accounts of users who are determined, in our reasonable judgment, to be repeat infringers of copyright. A user may be considered a repeat infringer if they have had content removed following two or more valid DMCA takedown notices, or if they repeatedly upload content that infringes third-party intellectual property rights.

Abuse Warning

The DMCA provides significant legal penalties for submitting a fraudulent takedown notice. If you knowingly misrepresent that material is infringing, you may be liable for damages — including costs and attorneys' fees — incurred by the alleged infringer, Pirobeta Labs, or by us. Please only submit a takedown notice if you have a genuine, good-faith belief that infringement has occurred.
